This Privacy Policy discloses the online privacy practices for Rush Development, Inc. and its affiliates [collectively, “The Rush Companies” and/or “Rush”] and applies to the information we collect through www.therushcompanies.com [the “Site”].

Rush reserves the right, at any time, to modify, alter, update, or remove portions of this Privacy Policy. We will post any changes to this Policy on this page so you can readily review the most current version. We will alert you that changes have been made by indicating on the bottom of this Privacy Policy the date it was last updated.

We will provide notice of material changes by posting prominently on the Site or, where appropriate, by other reasonable means such as email to addresses we have on file for marketing communications.

 

Information we collect from you

We collect three basic types of information from you in conjunction with your use of the Site:

  • Personal information, which is any information that individually identifies you [e.g., your name, email address, telephone number].
  • Non-personal information, which is information that does not personally identify you but may include information about your interests, demographics [e.g., age, gender, occupation] and use of the Site.

  • Employment-application information, when you apply for a role through the Careers section. This may include your resume or CV, employment history, references, and any other information you choose to provide.
  • Strictly necessary / functional cookies. These are required for the Site to operate (for example, to remember form input or maintain a session). They cannot be disabled without breaking the Site.
  • Analytics cookies. We use Google Analytics (GA4) to understand how visitors use the Site so that we can improve it. Google Analytics may set cookies and collect information about your interactions with the Site. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, available from Google.
  • Marketing and CRM cookies. We use HubSpot to manage our customer-relationship and marketing programs. HubSpot may set cookies that allow us to recognize returning visitors, attribute marketing activity, and personalize follow-up communications. You can manage HubSpot cookies through your browser settings.
  • Personal details e.g. your name, address, email address, and telephone number.
  • Employment details e.g. specific employment information such as employment history or resume where provided by you in relation to any application for a role made by you via the Site where you have applied for a role via the ‘Careers’ section on the Site. Where required for hiring decisions and permitted by law, employment-application information may be used in connection with reference checks or background checks (subject to separate authorization at the time the check is run).
  • Inquiry details e.g. when you submit a property tour request, leasing inquiry, vendor or contractor inquiry, or general contact form, the information you provide in those forms.
  • Marketing preferences e.g. if you choose to subscribe to email newsletters or marketing communications.
  • To operate, maintain, and improve the Site and our services.
  • To respond to your inquiries, including property tour requests, project inquiries, leasing inquiries, and contractor or vendor inquiries.
  • To process and evaluate employment applications submitted through the Careers section.
  • To send marketing communications you have requested or that are otherwise permitted under applicable law, and to measure the effectiveness of those communications.
  • To analyze usage of the Site and produce aggregate reports.
  • To comply with legal obligations, enforce our terms, and protect the rights, property, and safety of Rush, our users, and the public.
  • To facilitate corporate transactions such as a merger, acquisition, financing, or sale of assets, where personal information may be transferred as part of the transaction subject to appropriate confidentiality protections.
  • Service providers and processors that operate on our behalf, such as website hosting, email delivery, customer-relationship and marketing automation (HubSpot), and analytics providers (Google Analytics). These providers are bound by contractual obligations to protect your information and use it only for the services they provide to us.
  • Affiliates within The Rush Companies family of businesses, for the purposes described in this Privacy Policy.
  • Professional advisors such as legal counsel, auditors, and insurers when reasonably necessary to operate our business.
  • Government authorities or other parties when required by law, subpoena, court order, or other legal process, or to protect the rights, property, or safety of Rush or others.
  • Acquirers in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets.

We do not knowingly collect any information, personal or otherwise, from children under the age of 13 without the express consent of their parent or guardian. We collect this information in the following ways:

Consistent with the Children’s Online Privacy Protection Act (COPPA) and applicable state laws, we do not knowingly sell or share the personal information of any minor under the age of 16 for cross-context behavioral advertising or for monetary or other valuable consideration. If you believe we have inadvertently collected such information, please contact us using the information below and we will delete it promptly.

Your IP address: Like most business websites, each time you visit the Site, we automatically collect your IP address and the web page from which you came. In order to administer the Site, diagnose technical problems, secure the Site against abuse, and analyze aggregate traffic and usage patterns, we use your IP address along with other technical signals. We do not use your IP address to attempt to identify you personally.

Rush will never rent or sell your email address to any third party or send you third-party solicitations.

  • Service providers and processors that operate on our behalf, such as website hosting, email delivery, customer-relationship and marketing automation (HubSpot), and analytics providers (Google Analytics). These providers are bound by contractual obligations to protect your information and use it only for the services they provide to us.

Transactional or service-related communications (for example, responses to your inquiries or follow-up on a leasing application) may continue regardless of your marketing preferences. Our email practices are designed to comply with the federal CAN-SPAM Act.

Your U.S. privacy rights

Depending on your state of residence (including California, Virginia, Colorado, Connecticut, Utah, and a growing list of other U.S. states), you may have the following rights with respect to the personal information we hold about you:

You may also designate an authorized agent to make a request on your behalf, subject to our verification of the agent’s authority.

Data retention

We retain personal information only as long as is reasonably necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, contractual, or reporting requirements, or to resolve disputes and enforce our agreements. When personal information is no longer needed, we securely delete or de-identify it.

Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No internet or email transmission is ever fully secure or error-free, however, and you should take care in deciding what information you send to us.

Legal basis for processing. International transfers. Rush is based in the United States, and our servers and most of our service providers are located in the United States. By using the Site or providing information to us, you understand that your information will be transferred to and processed in the United States. Where required by applicable law, we use appropriate safeguards (such as Standard Contractual Clauses) for transfers from the EEA, UK, or Switzerland to the United States.

California-specific disclosures

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA / CPRA), provides you with the rights described in the “Your U.S. privacy rights” section above. In the past 12 months we have collected the categories of personal information described in “Information we collect from you” above, for the business and commercial purposes described in “How we use your information,” and have disclosed personal information to the categories of recipients described in “Sharing of personal information.” We have not sold or shared (as those terms are defined under the CCPA / CPRA) personal information in the past 12 months. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Shine the Light. California Civil Code Section 1798.83 permits California residents to request information regarding our disclosure of personal information to third parties for the third parties’ direct marketing purposes. To make such a request, please contact us using the information below.

Washington-specific notice

If you are a Washington State resident, the Washington My Health My Data Act (MHMDA) provides specific protections for “consumer health data.” Rush does not knowingly collect consumer health data through this Site. If you believe Rush has collected consumer health data about you, please contact us using the information below and we will respond consistent with the Act.
